§ 265.71. Endorsement for record.

  • Every instrument presented to said Division of Land Records for recording, in order to entitle the same to be recorded, shall have a Recording and Endorsement Page attached to the front of the document and endorsed thereon a designation of the town or city in which the land affected by such instrument lies and, if it lies in two or more towns or cities, the name of each town or city in which the land affected by the instrument is situated. Such endorsement shall be in substantially the following form: "The property affected by this instrument is situated in the Town of _______ or City of _______ in the County of Westchester, New York." and the endorsement shall be recorded with such instrument preceded by the words "The following instrument was endorsed for record as follows:" Any person presenting an instrument affecting real property to said Division of Land Records for recording and indexing shall complete and submit such Recording and Endorsement Page on a form to be supplied by the County Clerk and in such format as may be required by the County Clerk. The Recording and Endorsement Page shall form part of the record, and as such shall have a page charge as specified by the New York State Civil Practice Law and Rules section 8021.
