§ 241.321. Powers and duties of Commissioner of Public Works and Transportation.

  • All functions and powers possessed by the Commissioner of Transportation and all rights and duties of the Department of Transportation, both of which are herein abolished, are hereby transferred and assigned to, assumed by, and do devolve upon the Commissioner of Public Works and Transportation and Department of Public Works and Transportation. All references in the Laws of Westchester County to the Westchester County Department of Public Works and Westchester County Commissioner of Public Works shall refer to the Westchester County Department of Public Works and Transportation and Westchester County Commissioner of Public Works and Transportation, respectively. Specifically, the Commissioner of Public Works and Transportation shall:

    1.

    Make such surveys, studies and analyses as may be necessary in the exercise of the powers and the performance of the duties set forth in this article.

    2.

    Confer with and advise transit operators in the county on any matter related to transit and public transportation in the county.

    3.

    Prepare public transportation and transit projects and applications to be presented by appropriate county officials for federal and/or state grants in aid.

    4.

    Undertake demonstration or feasibility projects, or pilot projects for the purpose of improvement or enhancement of public transportation and transit in the county.

    5.

    Prepare, in the name of the department and the county, such reports, maps, analyses, investigations and the like on those matters under this jurisdiction or that will improve or enhance the quality or level of public transportation or transit in the county.

    6.

    Formulate guidelines and policy for the maintenance and operation of transit equipment owned or leased by the county.

    7.

    Administer the acquisition and disposition and regulate and control the use of any capital equipment obtained by the county for transit and public transportation operation, from whatever sources, in accordance with the provisions of the County Charter and the Administrative Code.

    8.

    Advise the County Executive, the County Transportation Board, the County Planning Board and other departments, officials and agencies of the county with respect to any matter relating to transit and public transportation in Westchester County on which an opinion is requested, or on which he deems it advisable to report.

    9.

    Advise the appropriate officials of any of the cities, villages and towns in the county with respect to any matter affecting transit or public transportation in the county, city, town or village.

    10.

    Confer with or advise any other agency, governmental unit or organized transit body or association, either within or outside the county, with respect to any matter related to transit and public transportation in the county.

    11.

    Submit to the board estimates of receipts and proposed expenditures in connection with the preparation of the annual county budget prior to submission of such estimates to the Budget Director, and the commissioner shall set a time for a conference with the board on such estimates, which may be the date of a stated monthly meeting. The commissioner shall take into consideration, but shall not be bound by the recommendations of the board, as to such estimates. The board may submit to the Budget Director any recommendations that the commissioner declines to accept.

    12.

    The commissioner is hereby authorized and required to control, manage, maintain and operate all buildings and land owned by the county which are held, used and/or operated by the county for the Westchester County Airport, and the commissioner is further authorized to manage the operation of the Airport.

    13.

    The commissioner is hereby authorized to maintain all buildings and land owned by the county, which are held, used and/or operated by the county as transit facilities.
