§ 273.371. Reimbursement of Medical and Dental Care of Inmates.

  • (a)

    Westchester County shall be entitled to reimbursement or offset for costs paid by it on behalf of an inmate at the Westchester County Department of Correction for diagnoses, tests, studies or analyses for the diagnosis of a disease or disability, and care and treatment by a hospital, as defined in Article 28 of the New York State Public Health Law, or by a physician or by a dentist to an inmate from any third party coverage or indemnification carried by said inmate.

    (b)

    Such third party coverage or indemnification shall first be applied against the total cost to the hospital or other provider as established in accordance with the provisions of Section 2807 of the Public Health Law relating to rates of payments of an individual's care and treatment.

    (c)

    The Commissioner of the Department of Corrections shall promulgate regulations and rules as may be necessary to carry out the provisions of this law.

    Section 2. Severability. If any clause, sentence, paragraph, subdivision, section, rule or part of this local law shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, section, rule or part thereof directly involved in the controversy in which such judgment shall have been rendered.

    Section 3. This local law shall take effect January 1, 2008.
