§ 273.03. Commitment and discharge of prisoners.

  • Whenever any prisoner shall be sentenced by any magistrate, judge or court, it shall be the duty of such magistrate, judge or the clerk of the court to forthwith deliver to the Commissioner/Sheriff two copies of the order of commitment, both of which the Commissioner/Sheriff shall deliver with the prisoner to the Department of Correction. Whenever a prisoner shall be discharged by any magistrate, judge or court, it shall be the duty of such magistrate, judge or clerk of the court to forthwith deliver to the Commissioner/Sheriff a certificate of release directing that the prisoner be discharged from custody at a specified time and date. The Commissioner/Sheriff shall deliver the certificate of release forthwith to the Department of Correction. Notwithstanding the foregoing, orders of commitment and certificates of discharge shall be delivered directly to the Commissioner of Correction as to those prisoners for whom the transportation responsibility is assigned by law to the Department of Correction. The Commissioner of the Department of Correction shall file and preserve in his department all records pertaining to the commitment and discharge of prisoners and such other records of a prisoner's confinement as may be required by law.
