§ 241.181. Rules, regulations and ordinances; adoption and enforcement thereof.

    The Commissioner of Public Works and Transportation shall recommend to the County Board for adoption by act or local law such rules, regulations and ordinances as he deems necessary relating to all existing or future channel lines, governing (a) the construction and maintenance of any channel obstruction, (b) the construction and maintenance of any structure hereafter erected and maintenance of any structure heretofore existing, within a distance of 100 feet from any channel line established pursuant to the provisions of this article, to such extent as such regulation of adjacent structures may be necessary to prevent any danger of obstruction of the stream, watercourse, easement, or right-of-way bounded by such channel lines by reason of erosion or the collapse or other impairment of any such structure, and (c) matters on which he is empowered to act under the provisions of this article, including the issuing of notices and stop orders with respect to violations.

    A violation of any rule, regulation or ordinance adopted pursuant to the provisions of this article is hereby declared to be an offense against such rule, regulation or ordinance and shall be punishable for each violation by a fine or imprisonment or both not to exceed the maximum set by law. The said rule, regulation or ordinance may provide, as an alternative or in addition to such fine or imprisonment or both, civil penalties for any such violation in an amount not to exceed the maximum set by law for each violation, which shall be recovered in an action or proceeding brought by the County Attorney in the name of the county in a court of competent jurisdiction. Each day of a continuing violation shall be subject to a separate fine, imprisonment or civil penalty. An action or proceeding may be maintained by the County Attorney in the name of the county in a court of competent jurisdiction, to compel compliance with, or restrain by injunction any such violation of, such provision, rule or regulation, notwithstanding that another punishment for such violation is prescribed.
